Information pursuant to art. 13 D.lgs. 196/2003 and to art. 13 EU Regulation 2016/679

Legislative Decree (D.lgs) n. 196 of 30 June 2003 ("Code regarding the protection of personal data", hereinafter "Data Protection Code") and the Regulation (EU) 2016/679 on personal data protection ("Regulation") provide for the protection of natural persons with regard to the processing of personal data (hereinafter, the "Users") for the use of the services ("Services") provided through this website (hereinafter, the "Site").

According to the above regulations, we will base such processing on the principles of correctness, lawfulness and transparency, and protection of privacy and rights of the users of Kjuicer domains.

1. Data controller

The data controller is Kjuicer.com S.r.l. (hereinafter, "Kjuicer" or the "Controller"), with registered office in Via Ruggero di Lauria, 2 - 20149, Milan (MI).
The person responsible for data control is Giampaolo Ferradini

The representative of the Controller in the territory of the State is Giampaolo Ferradini, CEO of Kjuicer.

2. Type of data collected

The Controller collects the User's registration data, such as the email address, when the User decides to open his own account on the Site, and the navigation data (such as the type and version of the browser, the operating system and the IP address), related to the use of the services offered through the Site, collected through the use of cookies in accordance with the cookie policy below. The User has the right to add other information such as his name, surname, email address, nationality, telephone number, marital status, personal characteristics, hobbies and billing information. The Holder also collects the e-mail addresses of the recipients of a corporate account at the time of its creation ("Data").

The Controller employs services to understand the traffic on his site, for the collection of statistical data and the measurement of the effectiveness of advertising through understanding the actions that Users perform on the Site. These services, called Google Analytics, Piwik and Facebook Pixel, are respectively regulated by their Privacy policies. The data coming from these services consist of the IP address of the visitor, his approximate geographical location, type of browser used, language accepted by the browser and duration of visits, information concerning the visited page position, the document accessed, the redirect and the person using the website, data on buttons' clicks, pages visited after clicking on the buttons, personalized data (for example the conversions and the type of page), names of the fields of the modules when a person purchases a product or a service .
Google and Facebook Pixel's services are external, while the Piwik software is on the servers of the Controller.

3. Purposes of the processing

The data provided will be processed for the following purposes:

  1. use of the Services, the Site and its functionalities ("Contractual Purposes");

  2. registration on the Site by creating an account (personal or corporate), where documents that the User decides to create or collect through Kjuicer will be saved, to allow access to these documents from multiple devices ( "Contractual Purposes");

  3. with prior consent of the User, sending information, promotional and advertising material, such as for example newsletters containing Kjuicer material ("Marketing Purposes");

  4. fulfill the obligations established by applicable laws, European rules or regulations and / or respond to requests from public and governmental authorities ("Regulatory Purposes").

4. Methods of processing

The treatment will be carried out electronically and in manual mode. The Data is protected by appropriate security measures to guarantee the confidentiality and security of the Data.

5. Legal basis of the processing

The provision of Data for the purposes referred to in art. 3 (1) and (4) is mandatory to use the Site and its features.
The provision of Data for the purposes referred to in art. 3 (2) is required to use services that imply the creation of an account on the Site, with particular reference to the storage of documents and data and the creation of accounts themselves. Failure to provide the Data will make it impossible to access these services. In the current version it is possible to create Kjuicer documents also without having an account, but in the future this may no longer be possible and / or may result in the complete inability to use the service.
The provision of data for the purposes referred to in art. 3 (3) is optional. Failure to provide the consent does not affect the use of the Site by the User, but determines the inability for Kjuicer to send the User information material that may be of interest to him.

6. Communication of Data to Third Parties and communication of Data outside the European Union

To ensure the use of the Services and the Site, the Data will be communicated to third parties such as MailChimp, when the user chooses to receive updates via email from the Site, and Sentry, which provides an error tracking service, used to detect in real time errors that occur on the browser used by the User.

In case of login to Kjuicer through external sites and services (a procedure technically called OAuth), such as Google, Facebook or others the procedure involves the transfer of some information from those sites to the Site. To do this transfer, an authorization is required from such external sites themselves. The management of the original data is determined by their respective Privacy Policy of which Kjuicer is not responsible for.

7. Rights of the User

At any time the User can exercise his rights towards the Data Controller, pursuant to art. 7 of the Data Protection Code, by sending an email to privacy@kjuicer.com.

he User has the right to:

a) obtain confirmation of the existence or not of personal data concerning him, even if not yet recorded, and their communication in an intelligible form;

b) obtain indication of:
1. the origin of personal data;
2. the purposes and methods of processing;
3. the logic applied in case of treatment carried out with the aid of electronic instruments;
4. the identifying details of the controller, of the responsibles and of the representative designated according to article 5, comma;
5. the subjects, or categories of subjects, to whom the personal data may be communicated, or who can learn about them in their role of appointed representative in the territory of the State, of managers or agents.

c) obtain:

  1. updating, rectification or, when interested, integration of data;

  2. the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;

  3. the attestation that the operations referred to in letters (c) 1. and 2. have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case where fulfillment proves impossible, or it involves a use of means manifestly disproportionate to the protected right.

d) to object, in whole or in part:

  1. for legitimate reasons, to the processing of personal data concerning him, even if pertinent to the purpose of the collection;

  2. to the processing of personal data concerning him for marketing purposes, as sending of advertising material or direct sales or for carrying out market research or commercial communication.

8. What has changed when the EU Regulation became applicable?

The following previsions became effective as of May 25, 2018, as a consequence of the start date of the application of the Regulation.

  1. Data Retention Term: Kjuicer will retain the Data for the period necessary to fulfill the purpose for which it was collected pursuant to art. 3 above. In particular, the data collected for the purposes referred to in art. 3 are kept for the following periods:

    • for the Contractual Purposes referred to in numbers 1) and 2) the data will be kept for the entire duration of the contract and for the 10 years following the expiration of the same for defense purposes and / or to claim a right of Kjuicer in court and / or extrajudicial in case of disputes related to the execution of the contract;

    • for the Marketing Purpose referred to in number 3) they are kept for the entire duration of the User's registration to the Website as well as for the 2 years following the deactivation and / or cancellation of the same;

    • for the Regulatory Purposes as refferred to in number 4) they are kept for a period equal to the duration prescribed for each type of data by law.

    Upon reaching this deadline, the Data will be anonymized, aggregated and / or deleted.

  2. Additional rights: the User may at any time, according to the procedures set out in the previous art. 7,

    1. request the limitation of data processing in case:

      1. the user contests the accuracy of the same, for the period necessary to verify the accuracy of such Data;

      2. the processing is unlawful and the User objects to the deletion of the Data, requesting the limitation of its use;

      3. the Data are necessary for the User to ascertain, exercise or defend a right in court, unless KJuicer no longer needs it for processing;

      4. the user has opposed the processing pursuant to Article 21, paragraph 1, of the Regulation, pending the verification of the possible prevalence of the legitimate reasons of the Controller with respect to those of the User;

    2. oppose the processing of Data at any time;

    3. request cancellation of Data concerning him without unjustified delay;

    4. obtain the portability of Data concerning him;

    5. propose a claim to the Data Protection Authority where the conditions exist.

The KJuicer website uses cookies to make our services simple and efficient for users who visit the pages. When users access the Site minimum amount of information is inserted into the devices in use, whether computers or mobile devices, in small text files called "cookies" saved in the directories used by the user's web browser. When Kjuicer shows third-party pages edited with its tools, actually "redistributes" material already available online.
